However, if you withdraw your consent to receive our communications electronically, you must discontinue your use of your account.

This Site contains images, photographs and other information (referred to herein as“Content”). This Site and all Content are the copyrighted property of Marketmenow.co.uk. All rights in this site and its Content are reserved worldwide. It is strictly prohibited to copy, distribute, publish, or use any portion of the content except as expressly allowed in these Terms of Use. Marketmenow.co.uk reserves the right to add to, delete from, or modify any part of Content at any time without prior notice. The design tools provided on this Site employ a number of templates and designs which can be customised to your choice. However, we reserve the right to make all elements and templates available for use by other parties. You do not obtain any right or claim to any of the individual design elements through your creation of a design and/or your incorporation of a design into one or more products. Other customers may use the design tools that have similar or identical combinations of these elements and Marketmenow.co.uk does not guarantee that your design will not have similarities to other parties. It is solely your responsibility to obtain the advice of an attorney regarding whether the logo design is legally available for your use and does not infringe rights of another party.

Use of the site

You are granted permission to access and use this Site and its Content for the sole purpose of preparing and ordering products, (referred to herein as “Products”). Designs must be ordered for promotional use only. No other download, retention, use, publication, or distribution of any portion of the Content is authorized or permitted. Obtaining Products from Marketmenow.co.uk does not entitle you to use any portion of Content apart from the finished Products as they are supplied. You agree to use this Site in a responsible manner that is in full compliance with these Terms of Use and with your local laws and regulations. Without limitation, no portion of Content may be utilized as a trademark or service mark, for any pornographic use, for any unlawful purpose or use, to defame any person, to violate any person’s right of privacy or publicity, to infringe upon any copyright, trade name, trademark, service mark or other intellectual property right of any person or entity. You agree that you will not use the Site to produce Products that are offensive, unlawful, harassing, libelous, threatening, harmful, obscene, malicious or otherwise objectionable. Marketmenow.co.uk may terminate its service to customers found to be engaging in undesirable activities. There is no minimum age limit to using this site.

You are solely responsible for your use of Content in combination with any other images, graphics, text or other materials you incorporate into your Products. You agree that you will not include any text, image, design, trademark, service mark, or any copyrighted work of any third party in your Products unless you have obtained the appropriate authorisations from the owners. You warrant that your Products do not infringe upon any rights of any third party, including copyright, trademark, right of publicity or privacy, and will not libel or defame any third party, and that you have all required rights or permissions necessary to incorporate third party material into your Products, including any third party material made available via a third party design service which may be accessed via the Site. By placing an order on this Site, you warrant that you have all necessary permission, right and authority to place the order and you authorise Marketmenow.co.uk to produce the Products on your behalf. You grant Marketmenow.co.uk the right to copy, modify, create derivative works and vectorise any uploaded content (i.e., content you have uploaded) for the purpose of fulfilling your order.

Colour Printing

Efforts shall be made to obtain the best colour reproduction on customer work, however variation is inherent and therefore it should be understood and accepted that an exact match in colour and texture to images seen on screen cannot be guaranteed.

Delivery and Payment

The turnaround expected and stated from Marketmenow.co.uk is measured in Working days on which the clearing banks in the City of London are open for normal business. Should Marketmenow.co.uk fail to deliver within the Guaranteed turnaround Period, service credit of sort to the value of the item ordered will be given (redeemable against orders within 6 months). The customer will still be obliged to pay in full for the order in respect of whether it was late. When late delivery is at the result of a third party (carrier) the Turnaround may be extended by one Working day in order to allow for a longer period of time. These services rely on no delay on progress of the order by the customer, and if done so, the customer will not receive credit. Should expedited delivery be agreed the Marketmenow.co.uk seller shall be entitled to make additional charges on a time and materials basis to cover any overtime or any other additional costs involved, including without limitation, the cost of couriers or special delivery post. In the unlikely event that the marketmenow.co.uk reseller deems it necessary to re-print work, the Guaranteed Period shall recommence from the time of the marketmenow.co.uk resellers’ confirmation to the customer of its agreement to reprint the work. Your goods will usually be shipped within 72 hours by the method you selected at the checkout stage. We use Sage Pay to collect/process transaction information' and provide link to our security policy at https://www.sagepay.co.uk/policies/security-policy

Returns and Refunds

Returns or refunds are only accepted at our discretion when an order is deemed as ‘not commercially acceptable’. We do not hold responsibility for the delivery time of the product ordered, as after production this is the sole responsibility of Royal Mail.

Any errors identified within the printing of the product or non-delivery must immediately be reported to us by emailing support@marketmenow.co.uk with your reference number We will require you to return the original sample or produce photographic evidence upon request.

In order to qualify for a discretionary refund you will need to email us within 10 days of despatch. We will notify you if you qualify within 10 working days, and will process a refund within 30 days of confirmation. Price of the original product and any applicable delivery charges will be refunded.

Cancellation

Once submitted, your order will immediately be sent to production. Because of this no cancellations can be accepted.

Transfer of ownership

The customer must adhere to all shipment terms previously stated, and be aware that ownership transfers to a third party upon carrying. Marketmenow.co.uk cannot guarantee or be held responsible for a third party duty and any disruption to timing or damage. This means the risk of loss and title for such items used with Royal Mail and such other couriers will pass to the carrier and not be the responsibility of Marketmenow.co.uk. Ownership of and title to any work shall not pass to the customer and shall be retained by the Marketmenow.co.uk until payment is received in full in respect of the work.

Advice of damage, delay or partial loss of goods in transit or of non-delivery must be given in writing to Marketmenow.co.uk and the carrier within five clear days of delivery (or, in the case of non-delivery within 28 days of despatch of the goods) and any claim in respect thereof must be made in writing to the Marketmenow.co.uk reseller and the carrier within seven clear days of delivery (or, in the case of non-delivery, within 42 days of despatch). All other claims must be made in writing to the marketmenow.co.uk reseller within 28 days of delivery.

Insolvency

If the customer ceases to pay or cannot pay its debts and are deemed unable to pay its debts, Marketmenow.co.uk shall have the right not to proceed further with the contract or any other work for the customer and be entitled to charge for work already carried out (whether completed or not). Marketmenow.co.uk shall be entitled on the expiration of 14 days notice to dispose of such goods or property in such manner and at such price as Marketmenow.co.uk thinks fit and to apply the proceeds towards such debts.

Uncontrollable Circumstances

Marketmenow.co.uk shall be under no liability if it shall be unable to perform any obligation which is owed by it to the customer for any reason beyond his control such as fire, war, flood or strike. During the continuance of such a contingency the customer may, by written notice to Marketmenow.co.uk elect to terminate the contract and pay for work done and materials used, but otherwise accept delivery when available.

Laws and Legislation

These terms and conditions express how terms of the contract with customers shall be governed and construed in accordance with English law. English Courts shall have jurisdiction in relation to any matters arising in connection with any contract Marketmenow.co.uk and the customer which these terms are incorporated to.
